1. Inspection and report
The work is a home inspection as defined in ORC 4764.01(C): a visual examination of readily accessible components of a residential building for the client. The inspection and written report will follow ORC Chapter 4764 and the rules adopted under it, including OAC 1301:17-1-17 standards of practice and OAC 1301:17-1-16 code of ethics.
The inspection is visual, non-invasive and not technically exhaustive. It addresses conditions at the time of inspection, not future performance. Readily accessible means available for visual inspection without moving or dismantling personal property, destructive measures, or risk to people or property. The report will describe observed deficiencies within the required scope, recommend evaluation, repair or monitoring as appropriate, and list required components not inspected with the reasons. It will include the property address, inspection date, inspector's license number and expiration date, and scope and exclusions. Oral comments do not replace the written report.
2. Limitations and exclusions
The inspection is not a warranty, guarantee, insurance policy, code-compliance inspection, appraisal, engineering analysis or specialized trade evaluation. It does not determine concealed conditions, latent defects, remaining service life, repair costs, future failures, property value or environmental hazards. It does not include destructive testing, dismantling, moving furnishings or stored items, operating shut-off or unsafe systems, or entering unsafe or inaccessible spaces.
Unless separately agreed in writing, services exclude environmental testing or sampling, mold testing, radon testing, termite or wood-destroying insect (WDI) inspections, pools and spas, underground tanks and piping, septic systems, wells, and detached structures other than garages and carports. Applicable Ohio standards control the required scope; this summary does not reduce mandatory duties. A limited-scope service requires an expressly described, signed addendum before work begins.
Radon and termite/WDI services are not performed in-house by the Company or Shaun Atkinson. If offered, they are arranged through licensed third-party subcontractors. Before authorization, the client will receive the provider's identity, applicable licensing information, scope, separate terms and quoted fee. No third-party service is included in the home inspection fee. Each provider performs and reports its own work.
3. Fees, cancellation and access
The agreed inspection fee is due as stated above and is not contingent on findings or a real estate closing. No cancellation, rescheduling, trip or reinspection fee applies under this agreement. Additional services or return visits require a separate written scope and price approved in advance. Prepaid amounts for services not performed will be refunded; charges for completed work must have been expressly agreed in writing.
The client will arrange lawful access and required owner or seller permission, ask that utilities be on, keep accessible areas clear and secure pets. The inspector will not activate shut-off utilities or undertake unsafe work. Access restrictions will be documented. The client should promptly arrange recommended specialist evaluations and repairs.
4. Independence and conflicts
The inspector will disclose any business interest or relationship concerning the property or transaction in writing before the client signs. The inspector will not proceed with a prohibited conflict. This agreement does not accept an undisclosed interest.
The Company and inspector will not pay or accept referral or preferred-provider-list compensation, or accept compensation from anyone other than the client for recommending contractors, services or products. Payment by another party requires prior written client consent, including consent to compensation from more than one party where applicable. No such consent is implied here.
The Company and inspector will not perform or solicit compensated repairs, replacements or upgrades to inspected components before the related transaction closes and all contingent issues are resolved, consistent with ORC 4764.14(A)(4).
5. Confidentiality and report release
The report and findings are confidential. The report is released only to the client unless the client authorizes release in writing or the law requires it. This agreement does not automatically authorize release to an agent, seller, lender, attorney, insurer, subcontractor or other person. Legally required disclosures may include a court order or an authorized licensing-authority records demand. Any immediate-danger warning will be limited to what the law requires; it does not authorize general report release.
Optional written report release (leave blank for client-only delivery):
- Recipient name and email: ____________________
- Purpose and scope of release: ____________________
- Client signature authorizing this release: ____________________ Date: __________
If instructions are unclear or conflicting, delivery remains client-only until clarified in writing. Further releases require written authorization. The report is prepared for the named client; authorized receipt does not make another person a client or create an intended third-party beneficiary. Nothing restricts rights that cannot lawfully be restricted.
6. Software and service providers
We do not use artificial intelligence tools to process your inspection data unless we first tell you in writing.
We use service providers that host our website and email. This does not authorize disclosure of confidential inspection information. The report-release requirements in Section 5 continue to apply.
7. Photos and advertising
Inspection photographs document the inspection. This agreement does not authorize advertising use. Marketing use requires a separate written opt-in identifying the images and use, removal of identifying details, and express written consent of the current owner of record before the property is included in advertising, consistent with OAC 1301:17-1-16(E)(2). The default is no marketing use.
8. Records
The Company will retain this agreement, the report and inspection work-file documentation for five years from the inspection date under ORC 4764.11(B), and longer only when a legal obligation or preservation hold requires it. Records must remain under Company control and retrievable. A signed agreement copy will be provided to the client within three business days of signing.
9. Liability and insurance
This agreement imposes no contractual monetary liability cap and does not waive remedies available under applicable law. Inspection-scope limitations do not release responsibility for failing to perform agreed or legally required duties. ORC 4764.11(A) requires the licensed home inspector to maintain general liability insurance of at least $100,000 per occurrence and $300,000 aggregate. Those statutory insurance minimums are not a liability cap or a representation about coverage for a particular claim.
10. Concerns and disputes
Notify the Company at [email protected] promptly after discovering a concern and, when reasonably possible, allow an opportunity to review it before non-emergency repairs alter the condition. Preserve photographs and relevant evidence where safe. Do not delay emergency repairs, safety measures or steps needed to prevent further damage. Notice and an opportunity to revisit are not conditions to legal relief; no statutory deadline is shortened.
Ohio law applies, subject to mandatory applicable law. Parties may voluntarily agree to mediation after a dispute arises. There is no mandatory arbitration, jury-trial waiver, exclusive-county venue or restriction on lawful court remedies. Nothing limits a complaint to the Ohio Division of Real Estate & Professional Licensing.
11. Agreement and signatures
This agreement and signed addenda state the entire inspection agreement. Changes require written agreement by the client and inspector. If a provision is unenforceable, the remainder continues to the extent permitted by law without reducing mandatory consumer protections. Electronic signatures and counterparts may be used as permitted by law. The privacy policy does not expand inspection scope or authorize report release. By signing, the parties acknowledge the completed inspection details and agree to these terms.
